{"id":18670,"date":"2019-07-14T00:18:29","date_gmt":"2019-07-13T21:18:29","guid":{"rendered":"http:\/\/www.belediyeler.net\/?p=18670"},"modified":"2019-07-14T00:18:34","modified_gmt":"2019-07-13T21:18:34","slug":"anayasa-mahkemesi-24-yillik-gecekondunun-yikimini-haksiz-buldu","status":"publish","type":"post","link":"http:\/\/www.belediyeler.net\/?p=18670","title":{"rendered":"Anayasa Mahkemesi 24 y\u0131ll\u0131k gecekondunun y\u0131k\u0131m\u0131n\u0131 haks\u0131z buldu"},"content":{"rendered":"\n<p>Anayasa Mahkemesi, 24 y\u0131ld\u0131r kullan\u0131lan gecekondunun y\u0131k\u0131lmas\u0131nda ve hak sahiplerine yap\u0131 bedeli \u00f6denmemesinde m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fine h\u00fckmetti.<\/p>\n\n\n\n<p>Ankara&#8217;n\u0131n Alt\u0131nda\u011f il\u00e7esi Yenido\u011fan Mahallesi&#8217;ndeki bir gecekondunun, Alt\u0131nda\u011f Belediyesi taraf\u0131ndan imar uygulamas\u0131 sonucunda toplu konut alan\u0131nda kald\u0131\u011f\u0131 gerek\u00e7esiyle y\u0131k\u0131m\u0131na karar verildi.<\/p>\n\n\n\n<p>Bu karar gere\u011fince bina Belediye taraf\u0131ndan 2007&#8217;de y\u0131k\u0131ld\u0131. Ba\u015fvurucular, bu binaya ili\u015fkin 1983&#8217;e ait imar aff\u0131 m\u00fcracaat\u0131 yapt\u0131klar\u0131n\u0131, murisleri taraf\u0131ndan bu kapsamda 2 bin lira \u00f6dendi\u011fini belirtti.<\/p>\n\n\n\n<p>Ba\u015fvurucular, imar uygulamas\u0131 kapsam\u0131nda y\u0131k\u0131m nedeniyle olu\u015fan zarar\u0131n\u0131n tazmin edilmemesi nedeniyle Belediye aleyhine tazminat davas\u0131 a\u00e7t\u0131. Ankara 5. Asliye Hukuk Mahkemesi, 2010&#8217;da davan\u0131n idari yarg\u0131n\u0131n g\u00f6rev alan\u0131na girdi\u011fi gerek\u00e7esiyle g\u00f6rev y\u00f6n\u00fcnden reddetti.<\/p>\n\n\n\n<p>Ba\u015fvurucular g\u00f6revsizlik karar\u0131 \u00fczerine Ankara 1. \u0130dare Mahkemesinde, y\u0131k\u0131m nedeniyle olu\u015fan zarar\u0131n\u0131n tazmini istemiyle tam yarg\u0131 davas\u0131 a\u00e7t\u0131. Mahkeme, 2012&#8217;de davan\u0131n reddine karar verdi.<\/p>\n\n\n\n<p>Kararda, Belediye Kanunu&#8217;nun 73. maddesinin, kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim proje alanlar\u0131nda bulunan yap\u0131lar\u0131n bo\u015falt\u0131lmas\u0131 ve y\u0131k\u0131lmas\u0131na olanak tan\u0131d\u0131\u011f\u0131, Gecekondu Kanunu&#8217;nun 18. maddesi gere\u011fince de ruhsats\u0131z yap\u0131n\u0131n y\u0131k\u0131m\u0131 nedeniyle ba\u015fvuruculara yap\u0131 bedeli \u00f6denmemesine y\u00f6nelik idari i\u015flemde hukuka ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131 belirtildi. Dan\u0131\u015ftay 14. Dairesinin de 2015&#8217;te karar\u0131 onamas\u0131n\u0131n ard\u0131ndan karar kesinle\u015fti.<\/p>\n\n\n\n<p>Bunun \u00fczerine gecekondu sahipleri 2016&#8217;da Anayasa Mahkemesine bireysel ba\u015fvuruda bulunarak m\u00fclkiyet haklar\u0131n\u0131n ihlal edildi\u011fini \u00f6ne s\u00fcrd\u00fc.<\/p>\n\n\n\n<p>Karar<br>\nAnayasa Mahkemesi Birinci B\u00f6l\u00fcm\u00fc, ba\u015fvurucular\u0131n m\u00fclkiyet haklar\u0131n\u0131n ihlal edildi\u011fine, ihlalin ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131na karar verdi.<\/p>\n\n\n\n<p>Gerek\u00e7ede, imar uygulamas\u0131 sonucunda ba\u015fvuruculara ait ta\u015f\u0131nmaz\u0131n toplu konut alan\u0131nda kalmas\u0131 nedeniyle bu ta\u015f\u0131nmaz \u00fczerindeki ba\u015fvuruculara ait ruhsats\u0131z binan\u0131n y\u0131k\u0131ld\u0131\u011f\u0131 belirtildi.<\/p>\n\n\n\n<p>Binan\u0131n yap\u0131m tarihinin tam olarak tespit edilemedi\u011fi ancak ba\u015fvurucular\u0131n murisi taraf\u0131ndan bu yap\u0131ya ili\u015fkin 1983 y\u0131l\u0131nda yap\u0131lan imar aff\u0131 m\u00fcracaat\u0131 bulundu\u011fu vurgulanan gerek\u00e7ede, \u015funlar kaydedildi:<\/p>\n\n\n\n<p>&#8220;Belediye taraf\u0131ndan 2007 y\u0131l\u0131nda y\u0131k\u0131m i\u015fleminin ger\u00e7ekle\u015ftirildi\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda an\u0131lan binan\u0131n yakla\u015f\u0131k 24 y\u0131ld\u0131r ba\u015fvurucular\u0131n murisi ve ba\u015fvurucular taraf\u0131ndan kullan\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Somut olayda oldu\u011fu gibi kamu makamlar\u0131n\u0131n binan\u0131n y\u0131k\u0131m\u0131 i\u00e7in uzun s\u00fcre hareketsiz kalmas\u0131 binan\u0131n y\u0131k\u0131l\u0131p y\u0131k\u0131lmayaca\u011f\u0131 noktas\u0131nda belirsiz bir durumun olu\u015fmas\u0131na sebebiyet vermektedir. B\u00f6yle bir durumda ba\u015fvurucular\u0131n kamu makamlar\u0131n\u0131n uzun bir s\u00fcre boyunca devam eden edilgen tutumlar\u0131n\u0131n bir anda de\u011fi\u015febilece\u011fini \u00f6ng\u00f6rmelerini beklemek hakkaniyete ayk\u0131r\u0131 olacakt\u0131r.&#8221;<\/p>\n\n\n\n<p>Binan\u0131n uzun s\u00fcre boyunca kullan\u0131m\u0131n\u0131n ba\u015fvurucular bak\u0131m\u0131ndan \u00f6nemli bir ekonomik menfaat te\u015fkil etti\u011fine i\u015faret edilen gerek\u00e7ede, derece mahkemelerinin tek ba\u015f\u0131na binan\u0131n ruhsats\u0131z oldu\u011fu olgusundan hareket edip olay\u0131n geli\u015fiminde kamu makamlar\u0131n\u0131n edilgen tutumunu dikkate almamalar\u0131n\u0131n b\u00fct\u00fcn zarara tek ba\u015f\u0131na ba\u015fvurucular\u0131n katlanmas\u0131 sonucuna yol a\u00e7t\u0131\u011f\u0131 belirtildi.<\/p>\n\n\n\n<p>Bu yakla\u015f\u0131m\u0131n da ba\u015fvuruculara \u015fahsi olarak a\u015f\u0131r\u0131 ve ola\u011fan d\u0131\u015f\u0131 bir k\u00fclfet y\u00fckledi\u011fi ifade edilen gerek\u00e7ede, &#8220;Bu durumda ba\u015fvuruculara herhangi bir tazminat da \u00f6denmedi\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131 ile kamunun yarar\u0131 aras\u0131nda olmas\u0131 gereken adil dengenin ba\u015fvurucular aleyhine bozuldu\u011fu ve m\u00fcdahalenin \u00f6l\u00e7\u00fcl\u00fc olmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r. A\u00e7\u0131klanan gerek\u00e7elerle Anayasa&#8217;n\u0131n 35. maddesinde g\u00fcvence alt\u0131na al\u0131nan m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.&#8221; g\u00f6r\u00fc\u015f\u00fcne yer verildi.<\/p>\n\n\n\n<p>Yeniden yarg\u0131lama<br>\nGerek\u00e7ede, somut olayda ba\u015fvuruculara ait ruhsats\u0131z binan\u0131n, imar uygulamas\u0131 kapsam\u0131nda y\u0131k\u0131ld\u0131\u011f\u0131, fakat binan\u0131n kullan\u0131m\u0131n\u0131n ba\u015fvurucular a\u00e7\u0131s\u0131ndan m\u00fclk te\u015fkil etti\u011fi hususunun idare taraf\u0131ndan g\u00f6z ard\u0131 edilerek ba\u015fvuruculara herhangi bir tazminat \u00f6denmedi\u011fi aktar\u0131ld\u0131.<\/p>\n\n\n\n<p>Sonu\u00e7 olarak, ba\u015fvurucular\u0131n m\u00fclkiyet hakk\u0131n\u0131n idari bir eylem nedeniyle ihlal edildi\u011finin anla\u015f\u0131ld\u0131\u011f\u0131 belirtilen gerek\u00e7ede, \u015fu de\u011ferlendirmelerde bulunuldu:<\/p>\n\n\n\n<p>&#8220;Ancak somut olayda ihlale yol a\u00e7an idari eylem ve i\u015fleme kar\u015f\u0131 ba\u015fvurulabilecek kanun yolu t\u00fcketildikten sonra bireysel ba\u015fvurunun yap\u0131ld\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131na g\u00f6re ilgili mahkemenin yeniden yarg\u0131lama yoluyla tespit edilen ihlali ve sonu\u00e7lar\u0131n\u0131 ortadan kald\u0131rma imkan\u0131 bulunmaktad\u0131r. Bu durumda m\u00fclkiyet hakk\u0131n\u0131n ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmaktad\u0131r. Buna g\u00f6re yap\u0131lacak yeniden yarg\u0131lama ise 6216 say\u0131l\u0131 Kanun&#8217;un 50. maddesinin 2 numaral\u0131 f\u0131kras\u0131na g\u00f6re ihlalin ve<br>\nsonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131na y\u00f6neliktir. Bu kapsamda derece mahkemelerince yap\u0131lmas\u0131 gereken i\u015f, ihlal sonucuna uygun olarak gerekli ara\u015ft\u0131rma yap\u0131lmak suretiyle tazminata h\u00fckmedilmesinden ibarettir. Tazminat miktar\u0131n\u0131n belirlenmesi hususu ise bu konuda uzmanla\u015fm\u0131\u015f derece mahkemelerinin takdirindedir.
