Aky\u00fcrek, teklifin, aralar\u0131nda \u0130mar Kanunu&#8217;nda bulundu\u011fu 10 kanunda de\u011fi\u015fiklik yapt\u0131\u011f\u0131n\u0131, imar, iskan, idari yarg\u0131lama usul\u00fc, gecekondu, yap\u0131 denetimi mevzuatlar\u0131nda \u00f6nemli de\u011fi\u015fikler i\u00e7erdi\u011fini bildirdi.<\/p>\n\n\n\n<p>\u0130mar Kanunu&#8217;nda de\u011fi\u015fiklik teklifi TBMM&#8217;de<br>\nTeklifle, parsel baz\u0131nda imar tadilat\u0131n\u0131n art\u0131k yap\u0131lamayaca\u011f\u0131n\u0131 bildiren Aky\u00fcrek, k\u00fc\u00e7\u00fck alanlarda \u015fah\u0131slar\u0131n getirdi\u011fi imar de\u011fi\u015fiklik talepleri yerine, \u015fahs\u0131 de\u011fil b\u00f6lgeyi \u00f6ncelikle ele alan, \u015fehri, b\u00f6lgeyi bir b\u00fct\u00fcn d\u00fc\u015f\u00fcnen, ada baz\u0131nda imar tadilat\u0131n\u0131n olaca\u011f\u0131n\u0131 dile getirdi.<\/p>\n\n\n\n<p>Aky\u00fcrek, ferdi ba\u015fvurular\u0131n dikkate al\u0131nmayaca\u011f\u0131n\u0131, mahalle, b\u00f6lge, ada baz\u0131nda plan b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn sa\u011flanaca\u011f\u0131n\u0131 vurgulayarak, &#8220;Kamuoyundaki birtak\u0131m tart\u0131\u015fmalar\u0131, \u015fah\u0131s lehine imar tadilatlar\u0131 yap\u0131ld\u0131\u011f\u0131 gibi d\u00fc\u015f\u00fcnceleri \u00f6nlemi\u015f olacak. B\u00f6lge bir b\u00fct\u00fcn d\u00fc\u015f\u00fcn\u00fclm\u00fc\u015f olacak. \u0130mar tadilat\u0131yla e\u011fer bir de\u011fer art\u0131\u015f\u0131 ortaya \u00e7\u0131k\u0131yorsa bunun tamamen kamuya mal edilmesi, ilgili belediye, il\u00e7e, b\u00fcy\u00fck\u015fehir belediyesi, Hazine ve Maliye Bakanl\u0131\u011f\u0131, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 taraf\u0131ndan bu de\u011fer art\u0131\u015f\u0131n\u0131n tahsili \u00f6ng\u00f6r\u00fcl\u00fcyor. Bu \u00e7ok \u00f6nemli bir yenilik. Tamamlamazsa, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131m\u0131z do\u011frudan devreye girerek, masraf\u0131n\u0131 da ilgili belediyeden, idareden alarak yapacak. Belediyelerimiz, meclislerinden h\u0131zl\u0131ca karar alacaklar. B\u00f6ylece yatay yap\u0131la\u015fman\u0131n, kanunla da te\u015fvik edilmesi sa\u011flanm\u0131\u015f olacak. B\u00f6lgeye uymayan alanlarda rahats\u0131z edici y\u00fcksekliklere ula\u015fan, baz\u0131 yerle\u015fim yerlerinde 5-6 katl\u0131 binalar\u0131n aras\u0131nda birden 15 katl\u0131 iki tane bina \u00e7\u0131km\u0131\u015f. Bu tip yap\u0131la\u015fma art\u0131k engellenmi\u015f olacak. Bu da \u00e7ok \u00f6nemli bir yenilik.<\/p>\n\n\n\n<p>Sadece mevzuat d\u00fczenlemeleri yetmez. Bir mant\u0131k geli\u015ftirmemiz gerekiyor. Bu mant\u0131kta, ba\u015fkas\u0131n\u0131n haklar\u0131na sayg\u0131 g\u00f6steren, imar haklar\u0131nda \u015fehre haks\u0131zl\u0131k yapmamaya gayret g\u00f6steren, yatay mimariyi te\u015fvik eden anlay\u0131\u015fla \u015fehirlerimizin daha insani ve ya\u015fanabilir \u015fehirler olmas\u0131n\u0131 sa\u011flayan, mevzuat\u0131n tam uygulanmas\u0131yla da bundan sonra ka\u00e7ak yap\u0131lar\u0131n yap\u0131lmad\u0131\u011f\u0131, yap\u0131 denetimi a\u00e7\u0131s\u0131ndan da g\u00fcvenli yap\u0131lar\u0131n olu\u015ftu\u011fu, daha mutlu, daha huzurlu, daha estetik, g\u00fczel \u015fehirler olu\u015fturmam\u0131z gerekiyor. Burada hepimize, vatanda\u015f\u0131m\u0131za, in\u015faat yapana, belediyelere, b\u00fct\u00fcn kurum, kurulu\u015flara bu konuda sorumluluk d\u00fc\u015f\u00fcyor. &#8220;<\/p>\n\n\n\n<p>Tabelalarla ilan<br>\nAda baz\u0131nda tadilat yap\u0131lan alanlarda, tadilat yap\u0131lan b\u00f6lgede etkin bir duyuru sistemi uygulanaca\u011f\u0131n\u0131 belirten Aky\u00fcrek, muhtarl\u0131klarda ve ileti\u015fim ara\u00e7lar\u0131yla ilan edilmesinin yeterli olmad\u0131\u011f\u0131na, bunun yan\u0131 s\u0131ra tadilat yap\u0131lan b\u00f6lgede ve alanda da tabelalarla halka ilan edilece\u011fine dikkati \u00e7ekti.<\/p>\n\n\n\n<p>Aky\u00fcrek, bug\u00fcne kadar bunun tam arzu edilen \u00f6l\u00e7\u00fcde yap\u0131lamad\u0131\u011f\u0131n\u0131 ifade ederek, &#8220;Bir b\u00f6lgede imar plan tadilat\u0131 yap\u0131l\u0131yor. Ama ilanlar, muhtarl\u0131klardaki ask\u0131lar takip edilmiyorsa, ilgili belediyedeki duyurular vatanda\u015f taraf\u0131ndan bilinemiyordu. Birden farkl\u0131 yap\u0131lar ortaya \u00e7\u0131k\u0131yordu. B\u00f6ylece itiraz konusunda da bir imkan\u0131 kalmam\u0131\u015f oluyordu. Tadilat yap\u0131lan alanda imar plan tadilat\u0131 tabelalarla ilan edilecek.&#8221; dedi.<\/p>\n\n\n\n<p>Mevcut uygulamada imar plan tadilatlar\u0131nda s\u00fcresiz dava a\u00e7\u0131labildi\u011fini, telafisi imkans\u0131z zararlar\u0131n ortaya \u00e7\u0131kabildi\u011fini dile getiren Aky\u00fcrek, teklifle ivedi yarg\u0131lama usul\u00fc ve davalarla ilgili s\u00fcre getirildi\u011fini belirtti.<\/p>\n\n\n\n<p>\u0130skele yap\u0131m\u0131na son<br>\nAky\u00fcrek, teklifle, sahillerde gerekmedi\u011fi halde yap\u0131lan iskelelerin de \u00f6nlendi\u011fine i\u015faret ederek, kayal\u0131k ya da sorunlu olmayan alanlarda iskele yap\u0131m\u0131n\u0131n yasakland\u0131\u011f\u0131n\u0131 bildirdi.<\/p>\n\n\n\n<p>Teklifin, oteller ve k\u0131y\u0131larda yap\u0131s\u0131 olan kurulu\u015flarla ilgili oldu\u011funu, bundan sonra rekreatif ama\u00e7l\u0131 iskele yap\u0131lamayaca\u011f\u0131n\u0131 vurgulayan Aky\u00fcrek, ancak kayal\u0131k ve \u00f6zel konumdaysa, izinle, belli \u00f6l\u00e7ekte yap\u0131laca\u011f\u0131n\u0131 s\u00f6yledi.<\/p>\n\n\n\n<p>Aky\u00fcrek, iskele yap\u0131ld\u0131\u011f\u0131na, denizin i\u00e7inde farkl\u0131 ama\u00e7larla kullan\u0131lan baz\u0131 mekanlar olu\u015fturuldu\u011funa i\u015faret ederek, K\u0131y\u0131 Kanunu&#8217;nda yap\u0131lan de\u011fi\u015fiklikle bunlar\u0131n \u00f6n\u00fcne ge\u00e7ilmesinin ama\u00e7land\u0131\u011f\u0131n\u0131 ifade etti.<\/p>\n\n\n\n<p>Tapuda \u015ferh<br>\n\u0130stanbul&#8217;daki ka\u00e7ak yap\u0131 cezas\u0131 ile Hakkari, Erzurum&#8217;daki ka\u00e7ak yap\u0131 cezalar\u0131n\u0131n ayn\u0131 oldu\u011funu an\u0131msatan Aky\u00fcrek, teklifle emlak beyan de\u011ferine g\u00f6re, de\u011fer tespitiyle oransal bir cezaland\u0131rma sisteminin getirildi\u011fini vurgulad\u0131. Aky\u00fcrek, de\u011ferli alanlarda yap\u0131lan ka\u00e7ak yap\u0131lar\u0131n farkl\u0131 cezaya tabi tutulaca\u011f\u0131n\u0131, cayd\u0131r\u0131c\u0131l\u0131\u011f\u0131n artaca\u011f\u0131n\u0131, ka\u00e7ak yap\u0131larla m\u00fccadelede \u00e7ok etkin bir y\u00f6ntem olaca\u011f\u0131n\u0131 anlatt\u0131.<\/p>\n\n\n\n<p>Ruhsata ve imar plan\u0131na ayk\u0131r\u0131 yap\u0131lara y\u00f6nelik, tapuda beyanlar hanesine \u015ferh konulaca\u011f\u0131n\u0131 belirten Aky\u00fcrek, sat\u0131n almak, kiralamak isteyenlerin ma\u011fduriyetinin de b\u00f6ylece engellenmi\u015f olaca\u011f\u0131n\u0131 s\u00f6yledi.<\/p>\n\n\n\n<p>Tahir Aky\u00fcrek, \u015funlar\u0131 kaydetti:<\/p>\n\n\n\n<p>&#8220;Burada \u015fu ama\u00e7lan\u0131yor: Bundan sonra ka\u00e7ak yap\u0131 yap\u0131lmas\u0131n. Bundan sonra imar plan\u0131na, in\u015faat ruhsat\u0131na, genel planlamam\u0131za ayk\u0131r\u0131 bir ka\u00e7ak yap\u0131 yap\u0131lmas\u0131n. Y\u0131k\u0131m bedelinin iki kat\u0131 ilgili kurumdan tahsil edilecek. Bu da cayd\u0131r\u0131c\u0131l\u0131k a\u00e7\u0131s\u0131ndan \u00f6nemli.<\/p>\n\n\n\n<p>\u0130mar bar\u0131\u015f\u0131ndan yararlanan binalarla ilgili de \u00f6zellikle deprem riskine kar\u015f\u0131 bir teklif var.
