Ancak bu kural uygulanam\u0131yor. Son olarak bir proje 31 d\u00f6n\u00fcml\u00fck arazinin ortas\u0131ndaki apartman\u0131n\u0131 bo\u015faltan ancak firmayla pazarl\u0131\u011f\u0131 s\u00fcrd\u00fcren A.D.\u2019ye tak\u0131ld\u0131. Benzer \u00e7\u00f6z\u00fcms\u00fczl\u00fcklerden hem in\u015faat \u015firketleri hem de bu \u015firketlerle anla\u015fan \u00e7o\u011funluk \u015fikayet\u00e7i.<\/p>\n<p>ELEKTR\u0130K, su kesik. Aylar \u00f6nce bo\u015falt\u0131lan apartman koskaca arazinin ortas\u0131nda yaln\u0131z ba\u015f\u0131na duruyor. Kom\u015fular\u0131 da Fikirtepe\u2019deki bu arazide yeni bir proje ger\u00e7ekle\u015ftirecek olan firma da inat\u00e7\u0131 ev sahibi A.D.\u2019yi bekliyor. A.D., \u201cArt\u0131k bu ada ve t\u00fcm b\u00f6lgede sorun \u00e7\u00f6z\u00fcls\u00fcn istiyoruz. Elektrik, su kesildi\u011fi i\u00e7in aylar \u00f6nce evi bo\u015fatt\u0131k. \u00dcst\u00fcne bir de anla\u015fma yapmad\u0131\u011f\u0131m i\u00e7in telefonla taciz edenler oldu. Ben firmadan net bir anla\u015fma ve teminat istedim. A\u00e7g\u00f6zl\u00fcl\u00fck ya da fazla para isteme gibi bir durum yok. Zaten k\u0131sa s\u00fcrede arsada konut yapacak firma ile el s\u0131k\u0131\u015f\u0131r\u0131z\u201d diyor.<\/p>\n<p>Asl\u0131nda Fikirtepe\u2019de onlarca projede A.D.\u2019ninkine benzer inatla\u015fmalar y\u00fcz\u00fcnden benzer s\u0131k\u0131nt\u0131lar ya\u015fan\u0131yor. B\u00f6lgede kentsel d\u00f6n\u00fc\u015f\u00fcm projesi hayata ge\u00e7iren firmalar yasa gere\u011fi hak sahiplerinden 3\u2019te 2\u2019siyle anla\u015fma sa\u011flay\u0131nca y\u0131k\u0131mlar ba\u015fl\u0131yor. Ne var ki bu kural, pratikte uygulanam\u0131yor. Bu nedenle de kentsel d\u00f6n\u00fc\u015f\u00fcm\u00fcn kilit noktas\u0131 haline gelen Fikirtepe\u2019de \u00e7al\u0131\u015fmalar ba\u015flayam\u0131yor. B\u00f6lgede 61 yap\u0131 adas\u0131ndan sadece 3 tanesine ruhsat verildi\u011fini s\u00f6yleyen in\u015faat sekt\u00f6r\u00fc temsilcilerine g\u00f6re, sorunu \u00e7\u00f6zmenin tek yolu 3\u2019te 2 esas\u0131n\u0131 d\u00fczenleyen \u00e7o\u011funluk yasas\u0131n\u0131 uygulanabilir hale getirmek.<\/p>\n<p>S\u00dcRE DOLDU H\u00c2L\u00c2 BEKLEN\u0130YOR<br \/>\nB\u00f6lgede anla\u015fma sa\u011flamayan hak sahiplerine \u0130stanbul Kentsel D\u00f6n\u00fc\u015f\u00fcm M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan 2013 Aral\u0131k itibariyle tebligatlar g\u00f6nderildi ve 60 g\u00fcn s\u00fcre verildi. S\u00fcrenin dolmas\u0131na kar\u015f\u0131n hi\u00e7bir i\u015flem yap\u0131lmad\u0131\u011f\u0131n\u0131 s\u00f6yleyen in\u015faat \u015firketlerinin temsilcileri, \u201cB\u00f6lgede sorunlar \u00e7\u00f6z\u00fcld\u00fc deniliyor ama \u00e7\u00f6z\u00fclmedi. 3\u2019te 2 kural\u0131 uygulanabilir hale getirilmeli ya da ba\u015fka bir form\u00fclle bu s\u00fcrecin \u00f6n\u00fc a\u00e7\u0131lmal\u0131. \u00c7evre \u015eehircilik Bakanl\u0131\u011f\u0131 iyi niyetli ama h\u00e2l\u00e2 bir \u00e7\u00f6z\u00fcm\u00fc yok. Bug\u00fcne kadar \u00e7o\u011funluk yasas\u0131n\u0131n hi\u00e7bir uygulama \u00f6rne\u011fi de olamad\u0131\u201d diyor. S\u00fcre\u00e7 in\u015faat firmalar\u0131n\u0131n mali y\u00fck\u00fcn\u00fc artt\u0131rman\u0131n yan\u0131nda, proje baz\u0131nda anla\u015fma sa\u011flayan ve yeni evlerinin bir an \u00f6nce tamamlanmas\u0131n\u0131 bekleyen vatanda\u015flar\u0131 da zor duruma sokuyor.<\/p>\n<p>M\u00dcLK\u0130YET HAKKI KORUNUYOR<br \/>\n3\u2019te 2 kural\u0131 ile oy \u00e7o\u011funlu\u011fu d\u0131\u015f\u0131nda kalan vatanda\u015flar\u0131n m\u00fclkiyet hakk\u0131n\u0131n korundu\u011funu belirten \u00c7evre ve \u015eehircilik Bakan\u0131 \u0130dris G\u00fcll\u00fcce, \u201cFikirtepe\u2019de anla\u015fma sa\u011flayan vatanda\u015flar\u0131m\u0131z ruhsatlar\u0131n\u0131 alarak i\u015flemlerini y\u00fcr\u00fct\u00fcyor. Bu ba\u011flamda, alanda y\u00fcr\u00fct\u00fclen \u00e7al\u0131\u015fmalarda herhangi bir problem yok. \u0130stanbul \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc konu ile ilgili yetkilendirildi ve uygulamalarda gecikme ya\u015fanmamas\u0131 i\u00e7in personel say\u0131s\u0131 a\u00e7\u0131s\u0131ndan g\u00fc\u00e7lendirildi. Ayr\u0131ca bu konuyla ilgili ayda yakla\u015f\u0131k 200 derne\u011fe cevap ve randevu veriyor, tamam\u0131yla temas etmek i\u00e7in gayret sarf ediyorum\u201d dedi.<\/p>\n<p>Yasa ne diyor?<br \/>\n6306 sayl\u0131 Afet Alan\u0131 Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015f\u00fcm\u00fc Yasas\u0131\u2019na g\u00f6re hak sahipleri 2\/3 oran\u0131nda uzla\u015f\u0131r ve geriye kalan 1\/3 uzla\u015fmamakta direnirse 1\/3\u2019\u00fcn pay\u0131 \u00f6ncelikle a\u00e7\u0131k artt\u0131rma suretiyle di\u011fer maliklere teklif ediliyor. Alan olmazsa kamula\u015ft\u0131rma yolu ile idare bu hisseleri sat\u0131n al\u0131yor ve yeni projenin orta\u011f\u0131 oluyor. S\u00f6z konusu yasan\u0131n uygulama a\u015famas\u0131nda sorun oldu\u011funu s\u00f6yleyen Gayrimenkul Hukuku Derne\u011fi Ba\u015fkan\u0131 Avukat Ali G\u00fcven\u00e7 Kiraz, \u201c\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131, in\u015faat firmalar\u0131na yapt\u0131\u011f\u0131n\u0131z 3\u2019te 2 s\u00f6zle\u015fmeyi bize yollay\u0131n s\u00fcre\u00e7 ba\u015flas\u0131n dedi. Oysa firmalar SPK onayl\u0131 bir kurumda s\u00f6z konusu arsan\u0131n de\u011ferlemesini yapmal\u0131 ve noterden malikler \u00e7a\u011fr\u0131larak yap\u0131lan toplant\u0131 ile 3\u2019te 2 karar\u0131n\u0131 almal\u0131yd\u0131. S\u00fcre\u00e7 ba\u015fta hatal\u0131 oldu\u011fu i\u00e7in uygulanam\u0131yor ve anla\u015fma d\u0131\u015f\u0131 kalan y\u00fczde 1\u2019lik k\u0131s\u0131m usule uyulmad\u0131\u011f\u0131 i\u00e7in bu duruma itiraz ediyor\u201d dedi.<\/p>\n<p>Her adada 5-10 ki\u015fi<br \/>\nF\u0130K\u0130RTEPE, Dumlup\u0131nar, E\u011fitim, Merdivenk\u00f6y Mahalleleri Sosyal Yard\u0131mla\u015fma ve K\u00fclt\u00fcr Derne\u011fi (F\u0130DEM) Ba\u015fkan\u0131 Erc\u00fcment Oru\u00e7, b\u00f6lgedeki sorunun \u00e7\u00f6z\u00fcm\u00fc i\u00e7in dernek olarak rapor haz\u0131rlad\u0131klar\u0131n\u0131 s\u00f6yledi. \u00d6nceki g\u00fcn 150 temsilcinin kat\u0131l\u0131m\u0131 ile toplant\u0131 yapt\u0131klar\u0131n\u0131 belirten Oru\u00e7, \u201cFikirtepe halk\u0131n\u0131n y\u00fczde 90\u2019\u0131 kentsel d\u00f6n\u00fc\u015f\u00fcm i\u00e7in imza verdi. Her ada da ortalama 5-10 ki\u015fi var. Biz hangi ada da kimlerin anla\u015fmad\u0131\u011f\u0131 y\u00f6n\u00fcnde bir rapor haz\u0131rlay\u0131p \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 ile payla\u015faca\u011f\u0131z. Amac\u0131m\u0131z sorunun \u00e7\u00f6z\u00fcm\u00fcne destek olmak\u201d dedi.<\/p>\n<p>1.340 bin metrekare<br \/>\nFikirtepe\u2019nin b\u00fcy\u00fckl\u00fc\u011f\u00fc<br \/>\n50 bin<br \/>\nyap\u0131lmas\u0131 beklenen yeni konut say\u0131s\u0131<br \/>\n3 y\u0131l<br \/>\nB\u00f6lgede beklenen s\u00fcre<br \/>\n40 milyar lira<br \/>\nB\u00f6lgede 5 y\u0131lda yarat\u0131lacak ekonomik b\u00fcy\u00fckl\u00fck<\/p>\n<p>Terk alanlar kime terk<br \/>\nKADIK\u00d6Y Fikirtepe b\u00f6lgesinde kentsel d\u00f6n\u00fc\u015f\u00fcm projesi yapan in\u015faat firmalar\u0131 arsalardan kamuya b\u0131rak\u0131lacak pay nedeniyle i\u015flemlere ba\u015flayamad\u0131. <\/p>\n<p>Ayn\u0131 konuda 2 yasa olunca arsalar il\u00e7e belediyesinde mi, Hazine\u2019de mi kalacak belinlenemedi. \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 ise b\u00fcy\u00fckl\u00fc\u011f\u00fc 500 d\u00f6n\u00fcm\u00fc bulan arsalar i\u00e7in \u2018Hazine\u2019 adresini g\u00f6sterdi.<\/p>\n<p>KADIK\u00d6Y Fikirtepe\u2019de kentsel d\u00f6n\u00fc\u015f\u00fcm projesi hayata ge\u00e7iren \u015firketler kamu kurumlar\u0131 aras\u0131ndaki anla\u015fmazl\u0131k nedeniyle de bekliyor. Firmalar kamuya b\u0131rakmakla y\u00fck\u00fcml\u00fc olduklar\u0131 terk alan\u0131n\u0131 kime b\u0131rakacaklar\u0131n\u0131 bilemedi\u011fi i\u00e7in gerekli i\u015flemlere ba\u015flayam\u0131yor. Kentsel d\u00f6n\u00fc\u015f\u00fcmde yol, ye\u015fil alan ve sosyal donat\u0131 alan\u0131 olarak de\u011ferlendirilecek arsalar\u0131n ilk etapta il\u00e7e belediyesine b\u0131rak\u0131lmas\u0131 bekleniyordu. Ancak Fikirtepe\u2019deki kentsel d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecine \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131\u2019n\u0131n girmesiyle i\u015flemler de\u011fi\u015fti.<\/p>\n<p>M\u0130LL\u0130 EMLAK\u2019A G\u00d6RE BELED\u0130YEN\u0130N<br \/>\nKentsel d\u00f6n\u00fc\u015f\u00fcm projelerinde ruhsat veren \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 ile mimari proje onay\u0131 veren \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi arsada kamuya b\u0131rak\u0131lacak terk alanlar\u0131n\u0131n hazineye b\u0131rak\u0131lmas\u0131 gerekti\u011fini s\u00f6yledi. Ancak Milli Emlak taraf\u0131ndan yap\u0131lan yaz\u0131l\u0131 a\u00e7\u0131klamada \u201c2644 say\u0131l\u0131 Tapu Kanunu\u2019nun 21. maddesinde k\u00f6y ve belediye s\u0131n\u0131rlar\u0131 i\u00e7inde kapanm\u0131\u015f yollarla yol fazlalar\u0131 k\u00f6y ve belediye nam\u0131na tescil olunur\u201d denilecek terk alanlar kabul edilmedi. Durum b\u00f6yle olunca terk alan\u0131 kime devredece\u011fini bilemeden tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne giden in\u015faat firmalar\u0131 temsilcileri parselleri birle\u015ftirip tek tapu haline getiremedi.<\/p>\n<p>BAKANLIK DURUMA EL KOYDU<br \/>\n\u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131 ise ge\u00e7ti\u011fimiz hafta Tapu Kadastro M\u00fcd\u00fcrl\u00fc\u011f\u00fc ve \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi\u2019ne bir yaz\u0131 g\u00f6nderdi. Yap\u0131lan yaz\u0131l\u0131 a\u00e7\u0131klamada Afet Riski Alt\u0131ndaki Alanlar\u0131n D\u00f6n\u00fc\u015f\u00fcm\u00fc Kanunu\u2019nun 3. maddesinin 2 f\u0131kras\u0131 gere\u011fi yakla\u015f\u0131k 500 d\u00f6n\u00fcm b\u00fcy\u00fckl\u00fc\u011f\u00fcndeki arsalar\u0131n hazineye devredilece\u011fi belirtildi. Yap\u0131lan a\u00e7\u0131klamada \u201c6306 say\u0131l\u0131 kanunun 2644 say\u0131l\u0131 Tapu Kanunu\u2019ndan daha sonra y\u00fcr\u00fcrl\u00fc\u011fe giren bir kanun oldu\u011fu g\u00f6zetilerek tescilin 2644 say\u0131l\u0131 kanunun 21. maddesine g\u00f6re k\u00f6y ve belediye nam\u0131na de\u011fil, 6306 Kanun\u2019un 3. maddesinin 4 f\u0131kran\u0131n 2. c\u00fcmlesi h\u00fckm\u00fcne g\u00f6re hazineye yap\u0131lmas\u0131 gerekir\u201d denildi. Ayr\u0131ca bu kanuna g\u00f6re uygulamada bulunan alanlarda yer alan tescil d\u0131\u015f\u0131 alanlar\u0131n, tapuda hazine ad\u0131na tescil edildikten sonra \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131na tescil edilerek tasarrufuna b\u0131rak\u0131laca\u011f\u0131 veya bakanl\u0131\u011f\u0131n talebi \u00fczerine TOK\u0130\u2019ye ve idareye bedelsiz olarak devredilece\u011fi belirtildi. Bakanl\u0131\u011f\u0131n yapt\u0131\u011f\u0131 a\u00e7\u0131klamadan sonra \u015fimdi g\u00f6zler tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnde. Bakanl\u0131ktan gelen yaz\u0131l\u0131 a\u00e7\u0131klama sorunu \u00e7\u00f6zmek i\u00e7in yeterli g\u00f6r\u00fcld\u00fc\u011f\u00fc takdirde, alt yap\u0131s\u0131 haz\u0131r olan in\u015faat \u015firketleri bu hafta projeleri i\u00e7in tek tapu al\u0131p ruhsat ba\u015fvurusunda bulunabilecek.<\/p>\n<p>Maksat d\u0131\u015f\u0131 kullan\u0131lamaz<br \/>\nF\u0130K\u0130RTEPE\u2019nin imar planlar\u0131nda, sosyal donat\u0131lar i\u00e7in vatanda\u015flar\u0131n r\u0131zas\u0131 ile y\u00fczde 25 oran\u0131nda bir terk \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fcn\u00fc belirten \u00c7evre ve \u015eehircilik Bakan\u0131 \u0130dris G\u00fcll\u00fcce, \u201dVatanda\u015f\u0131m\u0131z\u0131n r\u0131zas\u0131 ile terk edilen bu alanlar ye\u015fil alan, park, okul gibi hizmetlerde kullan\u0131lacak olup kamusal bir h\u00fcviyet kazanacak. Bu terk alanlar\u0131n\u0131n ba\u015fka bir maksatla kullan\u0131lmas\u0131 veya herhangi bir belediye taraf\u0131ndan kendi lehine olarak ta\u015f\u0131nmaz kayd\u0131 yap\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fil\u201d dedi.<\/p>\n<p>Kentsel Tasar\u0131m M\u00fcd\u00fcrl\u00fc\u011f\u00fc kuruyor<br \/>\nVATANDA\u015eLARIN kentsel d\u00f6n\u00fc\u015f\u00fcm projelerinde uzun s\u00fcredir ma\u011fdur oldu\u011funu s\u00f6yleyen Kad\u0131k\u00f6y Belediye Ba\u015fkan\u0131 Aykurt Nuho\u011flu, Kentsel Tasar\u0131m M\u00fcd\u00fcrl\u00fc\u011f\u00fc kurmak i\u00e7in \u00e7al\u0131\u015fmalara ba\u015flad\u0131klar\u0131n\u0131 dile getirdi.
