Soma&#8217;da 301 madenciye mezar olan madenin sahibi Alp G\u00fcrkan&#8217;\u0131n \u015firketinin \u0130stanbul &#8216;da yapt\u0131\u011f\u0131 191 metrelik kuleyi nas\u0131l yapt\u0131\u011f\u0131, kimin onay verdi\u011fi tart\u0131\u015fma konusu oldu. T\u00fcrkiye&#8217;nin en y\u00fcksek ikinci binas\u0131 i\u00e7in G\u00fcrkan&#8217;a \u0130stanbul B\u00fcy\u00fck\u015fehir ve \u015ei\u015fli Belediyesi&#8217;nin us\u00fcle uygun olmayan onay verdi\u011fi Meclis raporlar\u0131na yans\u0131d\u0131.<\/p>\n<p>Raporlara g\u00f6re arazi i\u00e7in \u00fc\u00e7 plan tadilat\u0131 meclise geldi. \u0130ki tadilatta in\u015faat oran\u0131 artt\u0131r\u0131ld\u0131. Radikal&#8217;den Ercan Sar\u0131kaya&#8217;n\u0131n haberine g\u00f6re, arazinin yakla\u015f\u0131k 12 bin metrekarelik k\u0131sm\u0131 kamuya a\u00e7\u0131k ye\u015fil alan olarak planlanmas\u0131na ra\u011fmen ye\u015fil alan fiiliyatta kamuya a\u00e7\u0131lmad\u0131. Normal \u015fartlarda net parsel yani 10 bin metrekare \u00fczerinden in\u015faat izni verilmesi gerekirken, kamu i\u00e7in ayr\u0131lan ye\u015fil alan da emsale dahil edilerek br\u00fct parsel 22 bin metrekare \u00fczerinden in\u015faata izin verildi. Bu da in\u015faat\u0131 yer \u00fcst\u00fcnde 44 bin metrekareye \u00e7\u0131kard\u0131. Y\u00fckseklik serbest b\u0131rak\u0131ld\u0131. Kotun en y\u00fcksekten al\u0131nmas\u0131na izin verildi. B\u00fcrokratlar\u0131n uyar\u0131s\u0131na ra\u011fmen madenci G\u00fcrkan&#8217;\u0131n &#8216;ya\u015fam odas\u0131na&#8217; \u00f6nce \u0130stanbul B\u00fcy\u00fck\u015fehir Belediye Meclisi daha sonra da \u015ei\u015fli Belediye Meclisi onay verdi. Alp G\u00fcrkan&#8217;\u0131n \u015firketi de bu plan ile 9&#8217;u yeralt\u0131nda 56 kat, 140 bin metrekarelik kule yapt\u0131. Bodrum katlar\u0131n tamam\u0131 isk\u00e2na a\u00e7\u0131ld\u0131. Fazlal\u0131klar\u0131 kimse g\u00f6rmedi. Kulede ka\u00e7ak b\u00f6l\u00fcmler oldu\u011fu iddialar\u0131n\u0131 in\u015faat ruhsat\u0131n\u0131 veren \u015ei\u015fli Belediyesi &#8220;Planlama tamamen \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi taraf\u0131ndan yap\u0131ld\u0131. Projeye ayk\u0131r\u0131 bir durum yok&#8221; diye reddetti.<\/p>\n<p>Arazi 1995 y\u0131l\u0131nda \u015ei\u015fli Belediyesi&#8217;nin yapt\u0131\u011f\u0131 1\/1000 \u00f6l\u00e7ekli Ayaza\u011fa 7. Etap Uygulama \u0130mar Plan\u0131&#8217;nda 15 metrelik yol, park ile yer\u00fcst\u00fcnde yakla\u015f\u0131k 26 bin metrekare in\u015faat alanl\u0131 (Emsal=1.20) M\u0130KS kullan\u0131m alan\u0131 (Perakende ve toptan ticaret, b\u00fcro hizmetleri, kirletici olmayan yan k\u00fc\u00e7\u00fck sanayi ve depolama) olarak planlanm\u0131\u015f. Araziyle ilgili ilk plan de\u011fi\u015fikli\u011fi 2003 y\u0131l\u0131nda yap\u0131lan 1\/5000 \u00f6l\u00e7ekli \u015ei\u015fli, Ayaza\u011fa Revizyon Naz\u0131m \u0130mar Plan\u0131&#8217;nda yap\u0131lm\u0131\u015f. Planla arazinin y\u00fczde 54&#8217;\u00fc ye\u015fil alan, y\u00fczde 46&#8217;s\u0131 &#8216;T3&#8217; lejantl\u0131 ticaret ve hizmet alanlar\u0131 kapsam\u0131na al\u0131nm\u0131\u015f in\u015faat hakk\u0131 ise yer \u00fcst\u00fcnde 33 bin metrekareye (Emsal=1.50) \u00e7\u0131kar\u0131lm\u0131\u015f. Ancak bu b\u00f6lge plan\u0131n\u0131 mahkeme 2005&#8217;te iptal etmi\u015f.<\/p>\n<p>Emsalsiz talepler<br \/>\nMahkeme plan\u0131 iptal edilince, kulenin yap\u0131ld\u0131\u011f\u0131 arazi sahipleri parsel baz\u0131nda plan tadilat\u0131 i\u00e7in \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi&#8217;ne ba\u015fvuruda bulunmu\u015f. 2006 y\u0131l\u0131n\u0131n temmuz ay\u0131nda yap\u0131lan ba\u015fvuruda arazi sahibi, arazisinde s\u0131n\u0131rs\u0131z y\u00fckseklikte, (H=serbest) ( i\u015f merkezi, ofis, b\u00fcro, \u00e7ar\u015f\u0131, al\u0131\u015fveri\u015f merkezi, otel, motel, konaklama tesisleri, rezidans,sinema , tiyatro, m\u00fcze, sergi salonu gibi k\u00fclt\u00fcr tesisleri ile lokanta, restoran gibi e\u011flenceye y\u00f6nelik kullan\u0131mlar, y\u00f6netim binalar\u0131, banka ve finans kurulu\u015flar\u0131n\u0131 kapsayan) turizm ve ticaret alan\u0131na al\u0131nmas\u0131n\u0131, in\u015faat emsalinin de 1.5&#8217;ten 2.30&#8217;a \u00e7\u0131kar\u0131lmas\u0131n\u0131 talep etmi\u015f. S\u0131n\u0131rs\u0131z bodrum kat isterken, in\u015faat kotunun arazinin en y\u00fcksek k\u0131sm\u0131ndan al\u0131nmas\u0131 ve emsalin br\u00fct parsel \u00fczerinden verilmesini istedi.<\/p>\n<p>B\u00fcrokratlar uyard\u0131<br \/>\n\u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi, bu talebi teklif haline getirip Belediye Meclisi&#8217;ne g\u00f6ndermi\u015f ve Meclis de \u0130mar ve Bay\u0131nd\u0131rl\u0131k Komisyonu&#8217;na havale etmi\u015f. Kurum ve kurulu\u015flardan teklif ile ilgili g\u00f6r\u00fc\u015f istenmi\u015f. Park ve Bah\u00e7eler M\u00fcd\u00fcrl\u00fc\u011f\u00fc &#8216;ye\u015fil alan azalt\u0131ld\u0131\u011f\u0131&#8217;, Ula\u015f\u0131m M\u00fcd\u00fcrl\u00fc\u011f\u00fc de &#8216;yolun olu\u015facak trafi\u011fi kald\u0131rmayaca\u011f\u0131n\u0131 belirterek olumsuz g\u00f6r\u00fc\u015f g\u00f6ndermi\u015f.<\/p>\n<p>\u0130BB Planlama M\u00fcd\u00fcrl\u00fc\u011f\u00fc de plan tadilat\u0131 teklifine kar\u015f\u0131 \u00e7\u0131km\u0131\u015f. \u0130mar ve Bay\u0131nd\u0131rl\u0131k Komisyonu taraf\u0131ndan haz\u0131rlanan rapora g\u00f6re Planlama M\u00fcd\u00fcrl\u00fc\u011f\u00fc de\u011ferlendirmesinde \u015funlar\u0131 dile getirdi: &#8220;S\u00f6z konusu parsel 22 bin metrekaredir. Emsalin 2.30 verilmesi halinde yaln\u0131zca zemin \u00fcst\u00fcnde 50 bin 615 metrekare in\u015faat alan\u0131 yarat\u0131l\u0131r. Ancak plan notlar\u0131nda parselin en y\u00fcksek noktas\u0131ndan kot al\u0131nmas\u0131, bodrum katlar\u0131n serbest b\u0131rak\u0131lmas\u0131 ve emsale dahil edilmeden isk\u00e2n edilmesi \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fcnden, parseldeki ger\u00e7ek yap\u0131 emsalinin 2.30 de\u011ferinin \u00e7ok \u00fczerinde olaca\u011f\u0131 g\u00f6r\u00fclmektedir. B\u00f6lgede halen B\u00fcy\u00fckdere Caddesi&#8217;ne cepheli ticaret parsellerinde maksimum emsal 2.30, b\u00f6lgedeki di\u011fer ticaret parsellerinde ise, in\u015faat emsali 2.00 olarak uygulanmaktad\u0131r. Kald\u0131 ki bu parselin B\u00fcy\u00fckdere Caddesi&#8217;ne cephesi bulunmamaktad\u0131r. Parsel konum olarak ada ortas\u0131nda yer almakta ve hi\u00e7bir yola cephesi bulunmamakta olup, yaln\u0131zca 10 metrelik \u00e7\u0131kmaz yoldan mahre\u00e7 almaktad\u0131r.&#8221;<\/p>\n<p>Yol bu y\u00fck\u00fc kald\u0131rmaz<br \/>\nM\u00fcd\u00fcrl\u00fck arazinin ula\u015f\u0131m a\u00e7\u0131s\u0131nda da k\u0131s\u0131tl\u0131 oldu\u011funa vurgu yap\u0131p &#8220;Parsel hem ula\u015f\u0131m a\u011f\u0131, hem de konum olarak k\u0131s\u0131tl\u0131 durumdad\u0131r. Bu nedenle b\u00f6lgenin ula\u015f\u0131m a\u011f\u0131 ve parselin yol ba\u011flant\u0131lar\u0131 \u00f6nerilen yap\u0131lanma ko\u015fullar\u0131na g\u00f6re olu\u015facak ve en az d\u00f6rt bodrum kat yap\u0131laca\u011f\u0131 varsay\u0131l\u0131rsa 116 bin 600 metrekare yap\u0131 kitlesinin yarataca\u011f\u0131 trafik y\u00fck\u00fcn\u00fc kald\u0131ramayacak durumdad\u0131r&#8221; diyor.<\/p>\n<p>Ye\u015fil alan azalt\u0131l\u0131yor<br \/>\nYe\u015fil alan uyar\u0131s\u0131 da yapan m\u00fcd\u00fcrl\u00fck \u015funlar\u0131 da dile getiriyor: &#8220;Daha \u00f6nce arazinin y\u00fczde 50&#8217;si ye\u015fil alanken, teklif ile bu y\u00fczde 25&#8217;e d\u00fc\u015f\u00fcr\u00fcl\u00fcyor. Teklif, yap\u0131, n\u00fcfus ve trafik yo\u011funlu\u011funu artt\u0131r\u0131c\u0131, plan b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozucu emsal te\u015fkil edici ve ye\u015fil alan donat\u0131s\u0131n\u0131 azalt\u0131c\u0131 niteliktedir. Teklif ile emsalin br\u00fct alandan hesaplanarak ye\u015fil alana ayr\u0131lan k\u0131sm\u0131n emsalinin de kullan\u0131lmas\u0131, parselin en y\u00fcksek noktas\u0131ndan kot al\u0131nmas\u0131, bodrum katlar\u0131n serbest b\u0131rak\u0131lmas\u0131 ve emsale dahil edilmeden isk\u00e2n edilmesi y\u00f6n\u00fcnde ayr\u0131cal\u0131kl\u0131 plan notlar\u0131 \u00f6neriliyor. Daha \u00f6nceki 1\/1000 \u00f6l\u00e7ekli uygulama imar plan\u0131nda yaln\u0131zca kamu eline ge\u00e7en yol alanlar\u0131n\u0131n emsal hesab\u0131na dahil edilebilece\u011fi, meyilden dolay\u0131 kazan\u0131lan isk\u00e2n katlar\u0131n\u0131n emsale dahil oldu\u011fu, bodrum katlar\u0131n en \u00e7ok 2 kat olabilece\u011fi ve bunlardan en az birinin tamam\u0131n\u0131n garaj olaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu nedenle teklif, trafik yo\u011funlu\u011funu artt\u0131r\u0131c\u0131, emsal te\u015fkil edici niteliktedir.&#8221;<\/p>\n<p>Oy\u00e7oklu\u011fu ile kabul edildi<br \/>\nB\u00fcrokratlar\u0131n uyar\u0131s\u0131na ra\u011fmen plan tadilat\u0131 teklifi \u0130stanbul B\u00fcy\u00fck\u015fehir Belediye Meclisi&#8217;ne gelmi\u015f. Teklifi de\u011ferlendiren \u0130stanbul B\u00fcy\u00fck\u015fehir Belediye Meclisi, emsalinin 2.00&#8217;ye \u00e7\u0131kar\u0131lmas\u0131n\u0131, 2 bodrum kat\u0131n emsale dahil edilmeden iskana a\u00e7\u0131lmas\u0131n\u0131, emsal hesab\u0131n\u0131 br\u00fct parsel \u00fczerinden yap\u0131lmas\u0131, kotun en y\u00fcksekten al\u0131nmas\u0131 arazinin y\u00fczde 54&#8217;\u00fcn\u00fcn ye\u015fil, y\u00fczde 46&#8217;s\u0131n\u0131n ise Ticaret ve Turizm alan\u0131 olarak planlanmas\u0131n\u0131 oy\u00e7oklu\u011fu ile kabul etti.
