Dairesi\u2019nin 2012\/10367 esas say\u0131l\u0131 dosyas\u0131nda 10.07.2014 Tarihinde y\u00fcr\u00fctmeyi durdurma karar\u0131 verdi. <\/p>\n<p>Dan\u0131\u015ftay 14. Dairesi karar\u0131nda AO\u00c7 M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan devredilen hayvanat bah\u00e7esinin 29 hektarl\u0131k bir alan\u0131 kapsad\u0131\u011f\u0131n\u0131, ancak proje i\u00e7in 217 hektarl\u0131k bir alan\u0131n yenileme alan\u0131 ilan edildi\u011fi ve bu alan\u0131n mutlak tar\u0131m arazisi oldu\u011funu belirtti. <\/p>\n<p>\u2018ZEM\u0130N YUMU\u015eAK DEV OYUNCAKLAR TEHL\u0130KEL\u0130\u2019<br \/>\nDan\u0131\u015ftay 14. Daire, verdi\u011fi kararda ANKAPARK\u2019ta yap\u0131lmas\u0131 planlanan dev oyuncaklar\u0131n tar\u0131m topra\u011f\u0131 olan arazide zeminin yumu\u015fak olmas\u0131 nedeniyle tehlike olu\u015fturdu\u011funa dikkat \u00e7ekti. Kararda, Atat\u00fcrk\u2019\u00fcn \u00e7iftlik olarak kullan\u0131lmas\u0131 amac\u0131yla miras b\u0131rakt\u0131\u011f\u0131 arazinin 2023 Ankara Vizyon plan\u0131nda \u201cAnkara\u2019n\u0131n ci\u011ferleri\u201d olarak planland\u0131\u011f\u0131, ancak alan\u0131n amac\u0131na ayk\u0131r\u0131 olarak yap\u0131lanmaya a\u00e7\u0131ld\u0131\u011f\u0131 gerek\u00e7eleriyle hayvanat bah\u00e7esinin ANKAPARK\u2019a d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesinde kamu yarar\u0131 olmad\u0131\u011f\u0131 belirtildi. Bu gerek\u00e7elerle Dan\u0131\u015ftay 14. Daire, hayvanat bah\u00e7esini yenileme alan\u0131 olarak ilan eden Bakanlar Kurulu Karar\u0131n\u0131n y\u00fcr\u00fctmesini durdurdu.<\/p>\n<p>Kararda \u00f6zetle bilirki\u015fi raporunda yer alan \u015fu gerek\u00e7elere yer verildi: <\/p>\n<p>\u201cDava konusu alan\u0131n \u2018Mutlak Tar\u0131m Alan\u0131\u2019 \u00f6zelli\u011fine sahip oldu\u011fu, bu \u00f6zelliklere sahip tar\u0131m alanlar\u0131n\u0131n alternatiflerinin bulunmas\u0131 durumunda tar\u0131m i\u00e7erisinde tutulmas\u0131n\u0131n 5403 say\u0131l\u0131 yasan\u0131n 13. Maddesinde a\u00e7\u0131k\u00e7a belirtildi\u011fi, dava konusu alan \u00fczerinde uygulamas\u0131 ger\u00e7ekle\u015ftirilen kullan\u0131mlar\u0131n, kentin ba\u015fka alanlar\u0131nda ger\u00e7ekle\u015ftirilmesine y\u00f6nelik Tar\u0131m, Orman ve G\u0131da Bakanl\u0131\u011f\u0131\u2019n\u0131n bilgisi ya da i\u015fbirli\u011fi ile alternatiflerin ara\u015ft\u0131r\u0131lmad\u0131\u011f\u0131, bu ara\u015ft\u0131rmalar\u0131n yap\u0131ld\u0131\u011f\u0131na ili\u015fkin varsa nesnel ve bilimsel \u00f6l\u00e7\u00fctlerin a\u00e7\u0131k\u00e7a ifade edilmedi\u011fi, alan\u0131n tar\u0131m d\u0131\u015f\u0131 kullan\u0131m\u0131na y\u00f6nelik kamu yarar\u0131 karar\u0131 ve \u0130l Toprak Koruma kurulunun uygun g\u00f6r\u00fc\u015f\u00fcn\u00fcn bulunmad\u0131\u011f\u0131\u2026\u201d <\/p>\n<p>\u201c\u00dcst \u00f6l\u00e7ekli plan olan 1\/25.000 \u00f6l\u00e7ekli 2023 Ba\u015fkent Ankara Naz\u0131m \u0130mar Plan\u0131 kapsam\u0131nda; dava konusu alan\u0131n Ankara metropoliten kentinin mek\u00e2nsal geli\u015fmesi ve b\u00fcy\u00fcmesi i\u00e7inde, kenti \u00e7evreleyen ye\u015fil ku\u015faklar\u0131n kent i\u00e7indeki devaml\u0131l\u0131\u011f\u0131n\u0131 sa\u011flayan a\u00e7\u0131k ve ye\u015fil alan olarak \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, AO\u00c7\u2019nin ba\u011flamsal tarihsel \u00f6zelliklerinden gelen \u2018tar\u0131m alan\u0131\u2019 niteli\u011finin korunmas\u0131 ve rekreasyon niteliklerinin b\u00fct\u00fcnle\u015ftirilmesinin hedeflendi\u011fi, AO\u00c7 arazisi i\u00e7inde yap\u0131lacak olan Koruma Ama\u00e7l\u0131 \u0130mar Plan\u0131\u2019nda \u201caktif, pasif ye\u015fil alanlar ve tahrip edilen alanlar\u0131n geri d\u00f6n\u00fc\u015f\u00fcm\u00fcn\u00fcn sa\u011flanmas\u0131 ve AO\u00c7\u2019nin korunmas\u0131n\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, bir ba\u015fka ifade ile bir yenileme s\u00f6z konusu olacaksa alan\u0131n tar\u0131msal nitelikten kentsel kullan\u0131ma d\u00f6n\u00fc\u015fm\u00fc\u015f par\u00e7alar\u0131n\u0131n yeniden tar\u0131ma ve do\u011fal niteli\u011fe kavu\u015fmas\u0131 y\u00f6n\u00fcnde bir stratejinin izlenmesi gerekti\u011finin alt\u0131n\u0131n \u00e7izildi\u011fi, metropol kentin geli\u015fme ve b\u00fcy\u00fcmesini y\u00f6nlendiren \u00fcst \u00f6l\u00e7ekli plan vizyon ve stratejisinin bir par\u00e7as\u0131 olarak \u00f6ng\u00f6r\u00fclen yenileme\/d\u00f6n\u00fc\u015f\u00fcm alanlar\u0131nda biri olarak AO\u00c7 alan\u0131n\u0131n zikredilmedi\u011fi, buna kar\u015f\u0131n dava konusu m\u00fcnferit ve noktasal \u00f6l\u00e7ekte bir giri\u015fim olarak Yenileme Alan\u0131 olarak ilan edilmesi, 1\/10.000 \u00f6l\u00e7ekli AO\u00c7, Hayvanat Bah\u00e7esi Yenileme Alan\u0131 Koruma Ama\u00e7l\u0131 Naz\u0131m \u0130mar Plan\u0131 de\u011fi\u015fikli\u011fi kapsam\u0131nda; planda \u00f6ng\u00f6r\u00fclen arazi kullan\u0131m karar\u0131 olan Hayvanat Bah\u00e7esi, Hayvanat Bah\u00e7esi Geli\u015fme Alan\u0131 ve ASK\u0130 Ar\u0131tma Tesisi Alan\u0131 kullan\u0131mlar\u0131n\u0131n, yukar\u0131da belirtilen \u00fcst \u00f6l\u00e7ek plan karar ve stratejileri ile \u00f6rt\u00fc\u015fmedi\u011fi, \u00fcst \u00f6l\u00e7ek plan kararlar\u0131nda \u201cAtat\u00fcrk Orman \u00c7iftli\u011fi arazileri \u00fczerinde konut, ticaret ve sanayi ama\u00e7l\u0131 yap\u0131la\u015fma yap\u0131lamaz\u201d h\u00fckm\u00fcne kar\u015f\u0131n, dava konusu alanda \u00fccretli giri\u015f yap\u0131larak kullan\u0131labilecek ticari alanlar\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, AO\u00c7 Yenileme Alan\u0131 ve Yenileme Geni\u015fleme Alan\u0131 olarak \u00f6ng\u00f6r\u00fclen alan\u0131n eskimesi ve k\u00f6t\u00fcle\u015fmesi nedeniyle yenilenmesi amac\u0131yla ili\u015fkilendirilebilecek ve kullan\u0131m de\u011ferini \u00f6ne \u00e7\u0131karan arazi kullan\u0131m bi\u00e7imleri de\u011fil, alan\u0131n kentle\u015ftirilmesine y\u00f6nelik ve alan\u0131n de\u011fi\u015fim de\u011ferine odaklanan arazi kullan\u0131m kararlar\u0131 geli\u015ftirdi\u011fi, alan\u0131n ticari faaliyetlerle dolu bir kentsel aktivite alan\u0131 olarak d\u00fczenlenmesinin hedeflendi\u011fi, 2 milyon 780 bin metrekare b\u00fcy\u00fckl\u00fc\u011f\u00fcnde ve yakla\u015f\u0131k 6 bin 500 ara\u00e7l\u0131k oldu\u011fu belirtilen otopark alan\u0131n\u0131n yarataca\u011f\u0131 sert zemin alan\u0131n\u0131n, tar\u0131msal alanda yarataca\u011f\u0131 bozulman\u0131n yan\u0131 s\u0131ra, olumsuz mikroklimatik etki yarataca\u011f\u0131, g\u00fcnl\u00fck ara\u00e7 giri\u015f \u00e7\u0131k\u0131\u015f\u0131n\u0131n, ula\u015f\u0131m akslar\u0131 \u00fczerinde olumsuz etki yarataca\u011f\u0131\u2026\u201d <\/p>\n<p>\u201cD\u00f6n\u00fc\u015f\u00fcm alan\u0131n\u0131n sosyal , k\u00fclt\u00fcrel, ekonomik, \u00e7evresel ve i\u015flevsel olarak \u00e7\u00f6k\u00fcnt\u00fcle\u015fmi\u015f ve k\u00f6hnele\u015fmi\u015f bir b\u00f6lge olarak tan\u0131mlanmas\u0131na y\u00f6nelik nesnel ve bilimsel ayr\u0131nt\u0131l\u0131 tespitlere dayanan herhangi bir et\u00fct \u00e7al\u0131\u015fmas\u0131n\u0131n yap\u0131lmam\u0131\u015f oldu\u011fu ve kentsel d\u00f6n\u00fc\u015f\u00fcm karar\u0131n\u0131n dayana\u011f\u0131 olarak kabul edilebilecek \u201ceskiyen kent k\u0131s\u0131mlar\u0131n\u0131n\u201d tespitinin ortaya konmam\u0131\u015f oldu\u011fu g\u00f6r\u00fc\u015f\u00fcne bilirki\u015fi raporunda yer verilmi\u015ftir.\u201d <\/p>\n<p>\u201cUyu\u015fmazl\u0131k konusu olayda; mevcut hayvanat bah\u00e7esinin yakla\u015f\u0131k 29 ha alan\u0131 kapsad\u0131\u011f\u0131, yenileme alan\u0131 olarak ilan edilen alan\u0131n ise yakla\u015f\u0131k 217 ha b\u00fcy\u00fckl\u00fckte bir alan\u0131 kapsad\u0131\u011f\u0131, dava konusu alan\u0131n metropoliten bir a\u00e7\u0131k alan ve metropol i\u00e7i tar\u0131msal alan niteli\u011fi ta\u015f\u0131d\u0131\u011f\u0131, s\u00f6z konusu alan\u0131n i\u00e7inde, 5366 say\u0131l\u0131 Kanun ile getirilen ama\u00e7lar\u0131n ger\u00e7ekle\u015ftirilebilece\u011fi yap\u0131 ve yap\u0131lar grubu sadece alan\u0131n y\u00fczde 13.3\u2019\u00fcn olu\u015fturan (eski) hayvanat bah\u00e7esi alan\u0131nda kald\u0131\u011f\u0131, bu noktada, \u00fczerinde yenilenecek (y\u0131k\u0131l\u0131p yeniden yap\u0131lacak) herhangi bir yap\u0131 bulunmad\u0131\u011f\u0131 yakla\u015f\u0131k 188 hektarl\u0131k \u00e7ok geni\u015f bir alan\u0131n yenileme alan\u0131n yenileme alan\u0131 olarak ilan edilmesinin, ilgili mevzuat\u0131n amac\u0131na ayk\u0131r\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Bu durumda bilirki\u015fi raporu ve belgelerin birlikte de\u011ferlendirilmesi sonucunda AO\u00c7 hayvanat bah\u00e7esinin Yenileme Alan\u0131 olarak kabul edilmesine ili\u015fkin Bakanlar Kurulu karar\u0131nda kamu yarar\u0131 ve hukuka uyarl\u0131k bulunmamaktad\u0131r.
